      The request or exercise of the above rights does not constitute a reason for less favourable treatment of the employee.

      Dismissal, notice of dismissal, or any other preliminary action in view of the dismissal of an employee is prohibited, from the date he/she notifies the employer in writing of his/her intention to take any of the above types of leave until the leave’s expiration.

      The notice of termination or the termination of employment during the above mentioned period, does not constitute an offense ONLY in the following cases:
      (a) if the employee is guilty of serious misconduct or behaviour which justifies the termination of the employment relationship
      (b) if the relevant business employing the employee has ceased to operate
      (c) if the duration of the employment contract has expired.
