What applies for products from countries outside the European Union?
The manufacturer situated outside the European Union is responsible for the design and construction of the products according to the basic requirements of the New Approach European Directives. This manufacturer, for the purpose of the legislation on CE conformity marking, may appoint an authorized representative, who must be situated within the European Union, so as to act on his behalf. If the manufacturer does not appoint an authorized representative, then the person who places the product on the European Union market has the responsibilities of the manufacturer. If the product is imported from a country outside the European Union, the importer has the obligation to ensure that the manufacturer has carried out all the necessary actions so that the product satisfies all the essential requirements of the European Directives that apply to this product. That is the product has CE conformity marking and is accompanied by the necessary documents which must be available to the competent authority if required.
