1. Harmonised Regulations for the placement on the market of new lifts and safety components for lifts requiring CE

On 4.11.2016 the harmonised Regulations titled «the Essential Requirements (Lifts and Safety Components for Lifts) Regulations of 2016 (R.A.A. 309/2016)» were published in the Official Gazette of the Republic.

The above Regulations transpose into the Cyprus legislation the provisions of the 2014/33/EU Directive on Lifts which regulate the free movement of lifts and safety components for lifts for which the CE mark is required.

The Regulations specify the essential safety and health requirements that lifts and safety components for lifts must fulfil so that they can be placed on the Cyprus market. Also, the Regulations specify the conformity assessment procedures and, among other things, impose new obligations on lift installers and manufacturers of safety components for lifts such as traceability, reporting to competent Authority for non-compliant or dangerous lifts.

The Regulations clarify, based on the European Regulation 765/2008/EC that sets the requirements for accreditation and market surveillance relating to the marketing of products, terms, obligations and authorities and powers of the Department of Labour Inspection as competent Authority.

2. Guide for the implementation of the Directive 2014/3//EU

The Guide for the implementation of the Directive 2014/3//EU put side by side the text of the Directive and useful information and interpretation that assist the manufacturer / installer to understand the text and apply correctly the provisions of the Directive.

The Guide was issued by the European Committee, after a consultation with the representatives of the member states that partake at the various Lifts Working Groups, the representatives of the lifts industry, standardisation bodies and Notified Bodies and others and following the prior approval of the Lifts Committee of the European Union.

The Guide is not legally binding but aims at the uniform interpretation and application of the provisions of the Lifts Directive.

The European Committee updates the Guide in order to include the latest views and decisions of the Lifts Committee in relation to new issues that may arise from the application of the Directive.

3. Approval from the competent Authority for deviating from requirement 2.2 of Annex I of the Regulations

Requirement 2.2 of Annex I of the Regulations refers to the risk of crushing when the lift car is at one of the upper or lower extreme positions of travel. The above requirement specifies that, to avoid the risk of crushing there must be free space or refuge available beyond the extreme positions so that the person trapped in one of the above positions, may seek protection.

In special cases, such as existing buildings where it is not possible to apply the above requirement, other measures may be applied to avoid the risk of crushing, but only after the approval of the competent Authority.

In this case the lift installer follows the procedure that was prepared for this purpose.
