1. Definition of posted worker
In accordance with the law, a 'posted worker' means a worker who usually works in the territory of one Member State and is temporarily posted to the Republic of Cyprus, in accordance with the provisions of local law, to perform their work for a limited period of time.
In accordance with the case law of the Court of Justice of the European Communities, the temporary nature of an activity carried out on the territory of a Member State in the context of free provision of services cannot be determined abstractly but should be judged on a case-by-case basis, depending on the duration, frequency and periodicity or continuity.
It should be noted that in Cyprus, if an occupational activity can no longer be considered as being exercised temporarily according to the above-mentioned criteria, but is instead stable and continuous, then all the binding rules and regulations that are in force in Cyprus apply.

In accordance with the law on the termination of employment, every employer and every employee must provide written notice of termination of the employment relationship, which shall be proportionate to their time of employment.
Where the employer terminates the employment relationship with the employee on their own initiative, then the minimum period of notice shown below must be given in writing:

Where the employee terminates the employment relationship with their employer on their own initiative, then the minimum period of notice shown below must be given in writing:

An exception is made for employees at
hotels and
leisure centres where the law provides for a period of notice even if an employee has been working for less than 6 months which shall be dependent on the period of employment.

6. Procedure for the submission of a complaint for employees from non-EU nationals
The complaint is initially submitted to the Regional Alien Unit of the Cyprus Police, it is stamped and then sent to one of the Regional Labour Relations Offices.
The competent officer will invite both parties to a joint meeting to examine the complaint.
