1. The provision of equal pay for equal work or work of equal value
Any gender discrimination is prohibited as concerns all elements and terms of pay for similar work or for work which generates the same value. Where an occupational classification system is used to determine wages, this must be based on common criteria for both men and women workers and it must be designed so as to prevent any gender discrimination. Comparisons between workers shall be made in reference to workers who are working or have worked for the same employer or another affiliated company of the same group of companies in the 2 previous years or the next 2 years.
2. Criteria for the comparison and evaluation of work
The criteria which are taken into account for purposes of comparison in a given occupational category or economic sector are:
- • The nature of the duties,
- • The level of responsibility,
- • Qualifications, skills and seniority,
- • The requirements in relation to physical or mental abilities,
- • The conditions under which the work is performed, and
- • The extent to which any difference in relation to the work performed or the terms under which the work is performed is of minor importance in relation to total work that is performed or the extent to which the frequency at which the differences occur does not affect the total work.
3. Process for the submission of complaints for citizens of Cyprus and of Member States
Complaints may be made by name or anonymously in the following ways:
- • By personal submission of the complaint to the Regional Offices of Labour Relations,
- • By telephone,
- • Via the website of the Department of Labour Relations
4. Duty to inform
In the event that a complaint is investigated or an inspection is carried out by an Inspector for the purposes of ensuring compliance with the law, each employer or representative and each employee of that employer must provide all information and/or data that they have in their possession to the Inspector.
