The obligation to provide the proportion of the 13th and/or 14th salary to employees, whose employment relationship is terminated during the year, is mandatory if those benefits were agreed and are part of the employee’s salary.


Nevertheless, if there is a written agreement or a provision in a collective agreement governing the employment relationship, which states that the proportion of the 13th salary shall not be paid upon termination, then the employer is not obliged to pay it.
