Committees and Councils - Technical Licensing Committee

The Protection against Ionising Radiation and Nuclear and Radiological Safety and Security Law of 2018 establishes a technical committee called "Technical Licensing Committee", whose task is to advise the Radiation Inspection and Control Service on granting authorisations through licensing.

The Committee discusses issues concerning the terms, requirements, conditions and prerequisites for granting authorisations, based on the Article 17 of the Law. The Committee may also discuss general terms, requirements and conditions for granting authorisations through licensing, as also provided for in Article 17 of the Law.

The following Ministries are represented in the Committee with one representative:

(i) Ministry of Labour and Social Insurance, through the respective representative of the Radiation Inspection and Control Service,
(ii) Ministry of Agriculture, Rural Development and the Environment,
(iii) Ministry of Health,
(iv) Ministry of the Interior,
(v) Ministry of Energy, Trade and Industry,
(vi) Ministry of Transport, Communications and Works.

Each Ministry represented in the Committee appoints a liaison officer for the operation of the Committee, who may also be the representative of the Ministry in the Committee.

Each represented Ministry may send different representatives to the various meetings of the Committee, however the non-continuous participation to the Committee meetings of the same representative of one Ministry cannot be used as a pretext for the active or non-active participation of the representative in one or more meetings or in expressing an opinion or making a contribution to the Committee.

Any representative of a Ministry participating in the Committee may be accompanied by a maximum of two scientific or technical advisers.

The Chairman of the Committee is the representative of the Ministry of Labour and Social Insurance, through the respective representative of the Radiation Inspection and Control Service. The meetings of the Committee are convened by the Chairman.

The Radiation Inspection and Control Service invites to the Committee meetings any District Administration, Municipality or Local Authority considers that it has an interest in the issues under discussion. Any interested District Administration, Municipality or Local Authority may send an observer to the meeting, who will have the right to speak but not to vote. If the body concerned fails to send an observer, it may send, in writing, views on the subject under discussion to the Chairman of the Committee.

The functions of the Committee are set out in the Second Table of the Law (related Articles 2, 17 and 20).
